Welcome to CherrySTEM! These Terms of Service ("Terms") govern your use of our educational software products and services. By accessing or using any CherrySTEM application, you agree to be bound by these Terms.

1. Acceptance of Terms

By registering for, accessing, or using any CherrySTEM service (including Novel Forge, Classroom Quiz Maker, ESL Tests, and other applications), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

CherrySTEM provides web-based educational software tools designed for writers, teachers, and learners. Our services include but are not limited to:

• Novel Forge - AI-powered creative writing studio
• Classroom Quiz Maker - Educational assessment tools
• ESL Tests - English language learning resources
• Additional educational applications as listed on cherrystem.net

3. License and Account Terms

3.1 Free Tier

We offer limited free access to our services with usage restrictions (e.g., daily AI generation limits). Free tier users must comply with all Terms and may have features restricted.

3.2 Pro/Premium Licenses

Premium features require a valid license key purchased through our authorized payment processor (Gumroad). Licenses are:

• Non-transferable and valid for one user
• Lifetime access unless otherwise specified
• Subject to fair use policies
• May not be shared, resold, or redistributed

3.3 Teacher Club Subscription

Teacher Club members receive access to all CherrySTEM applications for the duration of their active subscription. Subscription terms are as specified at time of purchase.

4. User Accounts

4.1 Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.

4.2 Account Security

You are responsible for all activities under your account. Notify us immediately of any unauthorized use.

4.3 Account Deletion

You may delete your account at any time through the application settings. Deletion is permanent and irreversible. We will remove your personal data as outlined in our Privacy Policy.

5. Intellectual Property Rights

5.1 Your Content

The CherrySTEM software, trademarks, logos, and underlying technology remain our exclusive property. You may not copy, modify, distribute, or reverse-engineer our applications.

5.3 AI-Generated Content

Content generated using our AI features becomes your property upon creation. However, you acknowledge that AI-generated content may not be protectable under copyright law in all jurisdictions.

6. Acceptable Use Policy

You agree NOT to:

• Use our services for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe on intellectual property rights of others
• Transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Use automated systems (bots) to abuse our AI services
• Resell, redistribute, or sublicense access to our services
• Generate content that is harassing, abusive, or discriminatory

7. Payment and Refunds

7.1 Payment Processing

Payments are processed securely through Gumroad. We do not store your payment information.

7.2 Pricing

Prices are as displayed at time of purchase. We reserve the right to change pricing for future purchases.

7.3 Refund Policy

Due to the digital nature of our products and instant license delivery:

• All sales are final
• Refunds are issued only for technical issues that prevent service access
• Refund requests must be made within 14 days of purchase

8. Data and Privacy

Your privacy is important to us. Our data practices are detailed in our Privacy Policy. Key points:

• We store your content securely in encrypted databases
• We use AI services (OpenRouter API) to provide features
• Your content is not used to train AI models
• You can export or delete your data at any time

9. Service Availability

9.1 Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted service. Maintenance windows will be announced when possible.

9.2 Service Changes

We may modify, suspend, or discontinue features with reasonable notice. Lifetime licenses apply to the service as it exists, not to any specific feature set.

10. Disclaimers and Limitation of Liability

10.1 "AS IS" Service

CherrySTEM services are provided "AS IS" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

10.2 AI Accuracy

AI-generated content may contain errors, inaccuracies, or inappropriate material. You are responsible for reviewing and editing all AI-generated content before use.

10.3 Limitation of Liability

In no event shall CherrySTEM be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse our AI services excessively
• Request a chargeback fraudulently

Upon termination, your right to access the service ceases immediately. Termination does not entitle you to a refund.

12. Governing Law

These Terms are governed by the laws of Thailand. Any disputes shall be resolved in the courts of Chiang Mai, Thailand. By using our services, you consent to this jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. Significant changes will be announced via email or in-app notification. Continued use of the service after changes constitutes acceptance of the new Terms.
